Waste charges correct - Federal Administrative Court rejects appeal on points of law

The waste disposal charges in the Ludwigsburg district are legal. This has now been confirmed by the Federal Administrative Court in Leipzig. The judges have rejected an appeal against the ruling of the Mannheim Administrative Court (VGH), which was not allowed to appeal. The court had already recognized the 2021 and 2022 waste management bylaws of the Ludwigsburg district as lawful in April last year.

"We are delighted that our legal opinion has been finally confirmed by the decision of the Federal Administrative Court," says District Administrator Dietmar Allgaier. "We now have legal certainty for the waste fees set in previous years and know that we can continue on this path in the coming fee years." The district of Ludwigsburg had included the costs for the aftercare of the landfills in its waste fees. The Initiative Müllgebühren Ludwigsburg (IMLB) had filed a complaint against this and demanded that these costs be covered by the general tax budget.

The courts have now declared the district's approach to be fully lawful. The proceedings have thus been finally concluded. "With our calculation of the fees, we can now successively distribute the costs for the aftercare of the landfills and thus avoid not only strong fluctuations in fees, but also an unfair distribution of these costs to future generations," says District Administrator Allgaier.
