Unaccompanied minor aliens (UMA)

Youth welfare services are responsible for the accommodation and care of unaccompanied minor aliens (UMA). Once they have been allocated by the state distribution office, it is the task of the General Social Service to find suitable accommodation for the young people and appoint a guardian. If unaccompanied minor foreigners report directly to the Ludwigsburg district, a clearing procedure is used to determine whether they are minors and to check whether they can be distributed nationwide.

Definition of unaccompanied minor aliens (UMA)

A UMA within the meaning of the law is any non-German person who is not yet 18 years old and who enters Germany without a guardian or legal guardian. If, for example, a relative is or becomes a legal guardian (e.g. by agreement with the legal guardian) or if a legal guardian is "found", the young person is not (no longer) unaccompanied. If the relative has already been appointed guardian by court order, the young person is also not unaccompanied.

Definition of legal guardian

According to Section 7 SGB VIII, legal guardians are the person with parental authority and any other person over the age of 18 who, on the basis of an agreement (no special form is required here) with the person with parental authority, assumes personal care tasks not only temporarily and not only for individual activities. A legal guardian can apply for social benefits for the young person, but cannot apply for asylum.

The district of Ludwigsburg must look after and care for approx. 4.89% of unaccompanied minors (UMA) in Baden-Württemberg in order to fulfill its admission quota. As of 20.11.2024, the district was looking after 233 UMAs.
