Climate protection laws of the country

Renewable energies play a particularly important role in buildings. The following should be noted:

For existing residential buildings

According to the state's Renewable Heat Act (EWärmeG), at least 15 percent of the annual heat requirement of existing residential buildings must be covered by renewable energy or the heat energy requirement must be reduced by at least 15 percent from 01.07.2015 if the central heating system is replaced. The building owner or an expert in accordance with § 20 must confirm that the requirements of this law are met. This certificate must be submitted to the Ludwigsburg District Office without being asked no later than 18 months after the new heating system is commissioned.

For new buildings

According to the Baden-Württemberg Climate Act (KSG), the obligation to install a photovoltaic system has applied to non-residential buildings since 01.01.2022 and to residential buildings since 01.05.2022. Further details are regulated by the Photovoltaic Obligation Ordinance (PVPfVo).

As proof, a confirmation from the Federal Network Agency regarding registration in the market master register in accordance with Section 8 (4) of the Market Master Data Register Ordinance must be sent to the Ludwigsburg District Office no later than 12 months after completion of the construction project.

The Climate Protection and Climate Change Adaptation Act stipulates various obligations for the installation of photovoltaic systems for electricity generation:

  • for new construction of non-residential buildings (from January 1, 2022)
  • for new residential buildings (from May 1, 2022)
  • for a fundamental roof renovation of a building (from January 1, 2023)
  • new construction of parking lots with more than 35 parking spaces (from January 1, 2022)

In October 2021, the Ministry of the Environment issued the Photovoltaic Obligation Ordinance, which specifies the provisions of the photovoltaic obligations for new buildings, basic roof renovations and parking lots.
