For all parents who look after their child or children in the household, the legislator has created the possibility of voluntarily using the assistance of the Youth Welfare Office within the framework of a guardianship after submitting a written application to establish paternity and/or assert the children's maintenance claims. This assistance does not restrict parental custody.
The guardianship can also be terminated at any time by a written declaration from the parent providing care.
Of course, you can also contact the Youth Welfare Office without wishing to set up a guardianship. As part of a consultation, we can help you clarify questions in the following areas:
- Establishing or contesting paternity
- Enforcement of maintenance
- Legal questions regarding custody and access rights
- In particular, questions about the possibility of exercising joint parental care in the case of parents who are not married to each other

The clerks in the business section are authorized to carry out notarizations in the following cases, among others:
- Acknowledgments of paternity with the corresponding declarations of consent

These are the declarations of the parents required by law if parents of a child who are not married to each other wish to exercise parental custody jointly.

Guardian
If there is no legal representation for a minor child, the competent family court orders guardianship. In this case, parental custody is not only transferred for a specific area of responsibility, the guardian receives full parental custody and thus becomes the child's legal representative. The youth welfare office can also be appointed as guardian if no suitable individual guardian is available.
Guardianship is ordered in the following cases, for example:
- Withdrawal of parental custody
- Death of the parents with joint custody or the parent with sole custody
- Suspension of parental custody (e.g. in adoption proceedings or if the parents are unable to attend due to unknown whereabouts)

Young people whose parents are unable to exercise their custody rights for various reasons need a legal representative (guardian) who is particularly committed to them and provides them with legal and personal support.
Voluntary guardians take care of, among other things
- adequate accommodation
- school matters
- the clarification of medical matters of considerable importance
- the settlement of financial matters
- correspondence with the authorities
In addition, personal contact with the young people should not be neglected.
