A pub license is required if, in a standing business accessible to everyone
- alcoholic beverages are served for consumption on the premises (pub) or
- prepared food is served in conjunction with alcoholic beverages for consumption on the premises (eating establishment).
If a restaurant is taken over from its predecessor in terms of space and operation and has not been closed for more than one year, the licensing authority can grant a provisional license under simplified conditions.
New regulations for shisha bars
There have also been several cases of carbon monoxide poisoning in shisha bars in Baden-Württemberg in the past. The odorless and colorless gas can cause serious damage to health and even death. Shisha bars must therefore now take various measures to prevent further poisonings.
The Ludwigsburg District Office has therefore issued a general decree on the use of hookahs in existing restaurants. Accordingly, every restaurant in which shisha pipes are smoked or offered for smoking must, for example, ensure that sufficiently dimensioned ventilation systems are installed to remove the carbon monoxide (CO) in the room air. It must also be ensured that a sufficient number of CO warning alarms are installed in the premises.

Responsible body
The responsibility for the approval of a restaurant is based on the responsibility under building law. This means that for the area of the large district towns including the administrative communitiesand municipalities with their own building law jurisdiction. The district administration office is responsible for the other municipalities.
