Legal basis

  • Via the following link "GMK resolution on the preparation of heat action plans (2020)", you can view the GMK resolution on the recommended preparation of heat action plans: "GMK resolution on the preparation of heat action plans (2020) " https://www.gmkonline.de/Beschluesse.html?id=1018&jahr=2020 An
  • excerpt from the resolution:
  • "The health ministers and senators of the federal states consider it necessary to draw up heat action plans within a 5-year period. In accordance with the principle of subsidiarity, these are to be drawn up primarily by the municipalities and affected institutions, taking into account the regional circumstances and specifics. This requires cooperation with all relevant stakeholders such as care services, the outpatient and inpatient care sector, the public health service and health insurance companies. The Federal Environment Ministry's recommendations for action should be used as a basis for this."
  • You can view the Water Resources Act via the following link "Second Act Amending the Water Resources Act (2023)" or download it as a PDF: "Second Act Amending the Water Resources Act (2023) " https://www.recht.bund.de/bgbl/1/2023/5/VO

An insight:

  • With the second law amending the Water Resources Act, which came into force in January 2023, the provision of tap water through drinking water wells in public places is considered a task of general interest. This means that local authorities are now obliged to install drinking water wells.
