"We can very well understand that the children in Hessigheim have a lot of fun on the BMX track and we don't want to spoil anyone's fun," says Dr. Christian Sußner, Head of Environment and Technology at the Ludwigsburg District Office. Nevertheless, the authorities were obliged to take action after a complaint was made. According to the Nature Conservation Act, such installations are not permitted in a landscape conservation area. "We are in a balancing act here between legal certainty and human understanding," admits Sußner.
The operators of the facility and the district authority have now reached an agreement. The facility can be used by the children for a further two years and must then be dismantled. There are also no administrative fees for the family concerned. "We have accommodated the family as far as possible. I think we have found a good compromise with this agreement," says Sußner
