In order to make it possible for citizens in the district to exchange the glass box for a garbage can as soon as possible, the supervisory board, district administration office and the district's waste recycling company (AVL) have discussed how to proceed. All parties involved on the district side have joined forces to find a citizen-friendly and quick solution. "A protracted legal dispute serves no one. We want households for whom the blue box is not sufficient to receive a blue garbage can as soon as possible," emphasizes District Administrator Dietmar Allgaier.
The coordination agreement between the district and the dual systems clearly stipulates that users can request an exchange of bin sizes free of charge. The dual systems are opposing this regulation for reasons that are incomprehensible to AVL and the district. Despite the clear legal situation, the central argument for the settlement is to be able to implement the container exchange for citizens in the short term. This is because the container exchange would take longer in the event of a legal dispute. The AVL Supervisory Board therefore also signaled yesterday in a non-public special meeting that it wanted to support a prompt settlement.
According to District Administrator Allgaier, positive signals for a compromise solution have also been received from the waste disposal companies PreZero and Kurz. A response from the dual systems is still pending, so a prompt and positive response is also expected from them.
If an agreement is reached, AVL, the dual systems and the two disposal companies PreZero and Kurz would each pay one third of the costs of the container exchange. AVL would finance the costs incurred from its private sector budget. "For us, it is crucial that the fees budget is not burdened by this," said District Administrator Allgaier.
During the consultation, the way forward was also outlined in the event that the settlement is not reached in the very short term. The district would pursue enforcement proceedings and instruct AVL to replace the containers in place of the disposal companies. The dual systems would then be called upon to reimburse the costs.
